This Brand Agreement (“Agreement”) governs how Brands access and use Creator data and other personal information made available through The Yard (the “Platform”). It supplements, and is incorporated by reference into, The Yard’s Terms of Service and Privacy Policy. By creating or using a Brand account, you agree to the terms below. Capitalized terms not defined here have the meaning given in the Terms of Service.
A Brand may access personal information and Creator data through the Platform only in connection with the Brand’s own campaigns. This includes the profiles, contact details, social media analytics, application materials, deliverables, and exported data of Creators who have applied to, been contracted for, or participated in that Brand’s campaigns.
The Platform does not provide, and a Brand may not attempt to obtain, bulk access to or a full export of the Creator database or of any data outside the Brand’s own campaigns.
A Brand may use the personal information and Creator data it accesses solely for its own internal purposes of operating, evaluating, and reporting on the specific campaign(s) for which the data was provided. Any other use requires the Creator’s and The Yard’s prior written consent.
As a condition of access, the Brand agrees that it will not:
Shared analytics links generated by a Brand are token-based and expire on the schedule the Brand configures. They expose only aggregated performance metrics and never include emails, phone numbers, or payment information. The Brand is responsible for distributing links only to intended recipients and remains bound by the restrictions in Section 3 with respect to any data accessible through them.
The Brand will protect personal information and Creator data using reasonable administrative, technical, and physical safeguards appropriate to its sensitivity, and will restrict access to personnel who need it for the relevant campaign. The Brand will promptly notify The Yard of any actual or suspected unauthorized access to or disclosure of such data.
The Brand will retain personal information and Creator data only as long as needed for the relevant campaign. The Brand will delete such data (including any local or exported copies) promptly upon the earliest of: the data no longer being needed for the campaign; a request from the Creator or The Yard; or termination of the Brand’s account, except where retention is required by law.
The Brand will comply with all applicable data protection and privacy laws in its use of personal information obtained through the Platform, and will honor any privacy rights requests forwarded to it by The Yard with respect to data in the Brand’s possession.
Violation of this Agreement is a material breach of the Terms of Service and may result in suspension or termination of the Brand’s account, fees or liquidated damages, and legal enforcement. This Agreement survives termination of the Brand’s account with respect to data the Brand obtained while it had access.
